1. Definitions
Grubba (also referred to as 'we', 'us', 'our') is a digital platform that enables Users to place orders for food, drinks, groceries, pharmaceuticals, event tickets, and other services from independent third-party vendors (the 'Vendors'). Users (also referred to as 'you', 'your') are individuals who create an account to use our platform. Customers are Users who place orders. Vendors are businesses listing their products and services on Grubba. Riders are our contracted in-house delivery personnel.
2. Account, Registration & Privacy
To access Grubba, Users must create an account using accurate, complete, and current information. You are responsible for safeguarding your account and password. Any activity under your account is your responsibility. We collect personal data (e.g., name, email, phone number, and location) strictly for login and identification purposes.
Grubba adheres to strict privacy practices. We do not sell or share your personal data with third parties. However, we may internally use this data for app improvement, internal advertising, and promotional purposes. You consent to receiving marketing notifications through the app.
3. Products & Vendor Responsibility
Grubba is a marketplace platform and does not own, manufacture, prepare, or sell any products. All responsibility for the safety, legality, quality, and accuracy of products lies with the Vendor.
Grubba does not assume liability for issues such as food contamination, allergic reactions, expired or mislabeled goods, or health concerns. Vendors must comply with local health and safety regulations. Any complaints regarding product quality should be directed to the respective Vendor.
4. Ordering Process
The ordering process on Grubba consists of the following steps:
- User downloads and installs the Grubba app.
- User registers and logs in to their account.
- User browses vendors and adds products/services to their cart.
- User proceeds to checkout and makes payment.
- Order is sent to the respective Vendor.
- Vendor accepts or declines the order.
- Once accepted and prepared, the order is dispatched to a Rider for delivery.
- Rider delivers the order to the User.
Order cancellation is allowed only before Vendor acceptance. Once an order is accepted, it cannot be cancelled or refunded except under exceptional circumstances.
5. Delivery Policy and Fees
Grubba provides delivery through in-house Riders. We are committed to environmentally sustainable delivery practices.
Delivery fees are calculated based on the straight-line (radius) distance between the Vendor and the Customer:
- Fixed fee of Ksh 30 for deliveries within a 1km radius.
- For distances above 1km, fee = Ksh 30 x distance in km.
- Example: 1.5km distance = 30 x 1.5 = Ksh 45.
A Ksh 10 service fee is charged per order to cover administrative and operational costs, such as server maintenance.
Grubba is responsible for the safety of the order only after it is collected by our Rider. Once delivery is complete, responsibility transfers to the Customer.
6. Vendor Terms and Commissions
All Vendors agree to a 10% commission on every order successfully placed and paid through the platform. This commission is automatically deducted from the Vendor's balance before payout. Grubba provides Vendors with a dashboard to manage listings, track orders, and view analytics.
We reserve the right to feature Vendor promotions, banners, and other materials within the app.
7. Sale of Alcohol and Age Restriction
The sale of alcohol is permitted on the platform. However, only Users aged 18 and above are allowed to purchase alcoholic beverages. Vendors and Riders must verify age when necessary. Any violation will lead to account suspension or removal.
8. Payment and Refunds
Grubba accepts various payment methods including mobile money (M-Pesa), debit/credit cards, and digital wallets. All payments are processed securely through encrypted channels.
Refunds are processed only in cases of order cancellation before vendor acceptance, vendor-initiated cancellations, or proven cases of non-delivery. Refund processing time may take 3-7 business days depending on the payment method.
9. Prohibited Activities
Users and Vendors are strictly prohibited from engaging in the following:
- Selling or purchasing illegal, expired, or harmful products.
- Misusing the app for fraudulent or abusive behavior.
- Uploading offensive, misleading, or false information.
Grubba reserves the right to take legal and disciplinary action including account termination.
10. Intellectual Property Rights
All content available on the Grubba app, including but not limited to logos, trademarks, text, images, designs, and code, are the property of Grubba or its licensors. Reproduction or unauthorized use is strictly prohibited.
11. Termination and Suspension
Grubba reserves the right to suspend or terminate any User or Vendor account that breaches these Terms. Accounts may also be terminated for inactivity, fraudulent activity, abuse of service, or if required by law.
12. Limitation of Liability
Grubba provides its services on an 'as is' and 'as available' basis. We make no warranties regarding service availability, reliability, or merchantability. Under no circumstances shall Grubba be liable for indirect, incidental, or consequential damages arising from use of the platform.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any dispute will first be attempted to be resolved through mediation. If unsuccessful, the dispute shall be settled through arbitration in Kenya.
14. Changes to Terms
Grubba may update these Terms and Conditions at any time. Users will be notified of significant changes. Continued use of the platform constitutes acceptance of the updated Terms.
